Bushfires
Section 203E of the Crimes Act 1900 (NSW) identifies that it is an offence for a person to
intentionally cause a fire, and
be reckless as to the spread of the fire to vegetation.
The offence carries a maximum penalty of up to 21 years. The seriousness of this offence due to the lack of regard for public safety is indicated in the gravity of the maximum penalty.
A person is exempt from criminal liability for this offence if:
the person is a firefighter or acting under the direction of a firefighter, and
the person caused the fire in the course of bushfire fighting or hazard reduction operations.
