Defences

If you have been charged with a criminal offence and wish to plead not guilty, you can raise a criminal defence. There is a range of defences in criminal law and our team of experienced criminal lawyers can assist you with raising the most appropriate defence for your circumstances.

These can be either partial or full defences. A partial defence will reduce the gravity of your charge, for example, reducing a murder charge to manslaughter. A full defence can get you acquitted of the charge entirely.

It is imperative to consult legal advice as an experienced lawyer can examine the circumstantial facts and evidence to propose a defence that is available and can best support your case.

There are several different types of defences you can raise including:

  • Automatism

  • Claim of right

  • Consent

  • Duress

  • Honest and Reasonable Mistake of Fact

  • Intoxication

  • Mental Health and Cognitive Impairment

  • Necessity

  • Provocation

  • Self-Defence

  • Substantial Impairment
